Control A.3.3: Reporting of concerns
Define and operate a process for people to raise concerns about what the organization does in relation to an AI system at any point in its life cycle.
What control A.3.3 asks
Define and operate a process for people to raise concerns about what the organization does in relation to an AI system at any point in its life cycle.
Why it matters for privacy
The person who notices that a model is producing a real customer's records is usually not the person with authority to stop it. A reporting route is the control that turns a concern into an action.
Where the draft lands: a concern about personal data needs somewhere to go. Privacy risk in operation is often seen first by a user of the system. The draft asks for risks to be identified across the lifecycle, which needs a route as well as a review.
Basis for A.3.3: the ISO page 56582 and the ISO/IEC 42001:2023 control record. No draft requirement is stated here: the abstract gives the direction and the text is not public. Operating, monitoring and telling people.
Evidence for control A.3.3
The list below is what a reviewer will want produced, not described. For control A.3.3 the list is written for an AI system that touches personal data, so a system with no personal data will need a subset.
- Concern reporting Concern reporting procedure with confidential or anonymous options
- Concern reporting Promotion of the channel to staff and contractors
- Concern reporting Investigation and escalation records and response times
- Concern reporting Anti-reprisal protections
Where control A.3.3 commonly fails
- Channel exists but is unknown to contractors
- No protection from reprisal
- Reports not escalated to management
What to do about control A.3.3 before the draft lands
Open a route that reaches outside the AI team, allow anonymous reports, and record what happened to each one. Test it with a privacy concern, not only with a safety concern.
Do not rebuild around a draft. Control A.3.3 already requires the evidence above, and the privacy preparation is the same control applied to the personal data an AI system touches.
